Court Sacks Benue APC Leadership

  • A Makurdi High Court has sacked the Benjamin Omale-led Seven-member Caretaker Committee overseeing the Benue State chapter of the All Progressives Congress (APC).
  • The court ruled that the dissolution of the Austin Agada-led State Working Committee (SWC) was unconstitutional.
  • The APC has appealed the ruling, filing a motion at the State High Court for a stay of execution of the judgement pending the hearing and determination of the appeal.

A Makurdi High Court, presided over by Justice Tertsea Kume, has nullified the Benjamin Omale-led Seven-member Caretaker Committee overseeing the Benue State chapter of the All Progressives Congress (APC). The court ruled that the dissolution of the Austin Agada-led State Working Committee (SWC) was unconstitutional, citing non-compliance with Section 36 of the Constitution of the Federal Republic of Nigeria and Article 21:1 of the APC constitution.

The court also noted that the applicants were not given fair hearing before their purported dissolution. In his ruling, Justice Kume nullified the constitution of the Seven-member Caretaker Committee and declared all actions taken by the committee null and void.

In response, the Chairman of the dissolved Committee, Benjamin Omale, stated that the judgment would be challenged at the Court of Appeal. The APC has also appealed the ruling, filing a motion at the State High Court for a stay of execution of the judgement pending the hearing and determination of the appeal.
