Chief Mufutau Kehinde has petitioned the Court of Appeal in Ibadan, Oyo State, to halt the ongoing construction of the Abeokuta/Kobape dualized road until his appeal is heard. Kehinde’s appeal challenges the judgment of Justice Mobolaji Ojo of an Ogun State High Court, which ruled in favor of the defendants and dismissed his claims.
Kehinde’s lawyer, Dr. Dada Awosika, SAN, has listed the Attorney-General of Ogun State and the Director-General, Bureau of Lands and Survey as respondents. The respondents have yet to file their responses to the appeal, and no date has been fixed for the appeal hearing.
Kehinde is seeking an order of injunction to restrain the respondents from further construction, meddling, interfering, or tampering with the land in question, which measures approximately 85.3 hectares. He argued that the ongoing construction has raised substantial points of law that the appellate court is likely to resolve in his favor.
